These Terms and Conditions apply to all sales concluded with you - the purchaser, via maryjanelingerie.co.uk – called “the website”. All contracts entered into are subject to these Terms and Conditions. By using the website you accept, understand and agree to abide by these Terms and Conditions.

NU reserves the right to amend Terms and Conditions whenever we feel it is necessary. You should check the Terms and Conditions every time you enter the Website. Your continued use of after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

If you do not accept these Terms and Conditions at any time then you should leave the Website.

Liability

1. maryjanelingerie.co.uk's range of goods are available for adult customers only. By placing an order, you declare that you are 18 years of age and have the legal right to possess adult products. If we discover that purchaser is not legally entitled to order certain goods, NU is not obliged to complete the order.

2. All orders placed through the Website are subject to availability and acceptance. We reserve the right to refuse to supply goods for any reason.

3. When you place an order to purchase a product from we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send this e-mail confirmation to you. Any products on the same order which we have not confirmed in a Confirmation E-mail do not form part of that contract. No contract for sale of any product will subsist between you and NU until the dispatch-confirmation e-mail has been sent. This does not affect the customer's statutory rights.

4. All items sold on maryjanelingerie.co.uk are sold as novelty goods. NU does not make or imply any therapeutic or medicinal claims or properties of any kind. NU also cannot be held responsible for any loss, damage or injury suffered as a result of improper use of any of products supplied.

5. NU makes no representation or warranties of any kind – and disclaims all with respect to the site and its contents. NU makes no representations and warranties about the accuracy, completeness, or suitability for any purpose of the information published in this site. The information contained in this site may contain technical inaccuracies or typographical errors. All liability of NU howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

6. The website is provided on 'as is' and 'as available' and we cannot guarantee that servers are free of viruses or errors. We also do not guarantee that all functions contained will be uninterrupted and content represents full functionality, reliability and accuracy. We cannot be responsible if we are unable to provide our Internet service for any reason being beyond our control.

7. NU will not be liable for loss or damages arising out of or in connection with maryjanelingerie.co.uk. This is a comprehensive limitation of liability that applies to all damages of any kind including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss or damage to property and claims of third parties.

9. You agree to use the website for lawful purposes only, in a manner that does nor restrict or inhibit use of this site by any third party and does not infringe their rights. Such inhibition or restriction includes without limitation any unlawful conduct or conducts that may harass or cause inconvenience or distress to any person.

Rights and contracts

10. While we take care to describe products accurately, NU cannot accept responsibility for slight colour variations that may occur – these are within the limitations of internet technology. Goods or their packaging may slightly differ from those displayed on the website. We do not accept liability for any errors, inaccuracies or omissions within information provided. Your statutory rights are unaffected by these terms and conditions.

Data Protection

1. NU – owner of maryjanelingerie.co.uk is compliant with Data Protection act. We will never pass or trade any personal details to any third party company other than involved in processing the order, without your prior consent. All orders placed online are SSL encrypted for your total peace of mind.

2. Please note that the actual card transaction will take place on a secure payment server belonging to Payment Service Provider (Paypal or Worldpay). Your card details will not be passed to NU or any third party other than payment service provider you choose, who will not retain your details (subject to individual account settings i.e. PayPal). They will only be used by the bank to collect your payment and at no time will they be stored by NU or be visible or accessible outside the secure banking network.

3. Your credit/debit card will be charged in the name of NU – owner of maryjanelingerie.co.uk.
    

Pricing

1. We do our best to ensure that prices of products featured on the website are correct on the date of entering, however we will need to validate the price before processing your order. In case of discrepancies of any kind, you will be notified as soon as it is possible. If it happens you may cancel your order and we will refund your payment in full.

2. We reserve right to change prices without notice.

3. Prices are displayed in Pound Sterling, and include Value Added Tax.

Delivery

1. All parcels will be dispatched within maximum 3-5 working days, however we aim to dispatch orders on the next business day or earlier.

2. Delivery by Royal Mail Recorderd Delivery anonymous envelopes or padded bags with no advertising logos or promotions. At present we use only one delivery method.

• Standard – 3.50 – usually 1-3 working days, however you should allow us up to 10 working days before contacting us if you order has not arrived, as Royal Mail class parcels lost after 15 workig days.

3. We cannot accept responsibility for goods that are damaged in transit, or for order delays caused by incorrect address information supplied.

Returns and Refunds

Unwanted purchases -

1. Any product you are not perfectly happy with may be returned within 14 days of receipt. Due to nature of the products listed, we are sure you understand that we cannot accept the return of any products that have been opened or used for hygiene reasons. Therefore goods must be with their original condition and packaging. Lingerie or costumes are only returnable if the product is defective or significantly differs from information supplied on the website. This also applies to products without heat seal packaging.

2. If the products is returned un-opened and un-used the refund for the value of the product or exchange will be offered to you. In the event of exchange the redelivery charges may apply.

3. Refunds for unwanted products paid for with credit/debit card will incur administration charge of £2.50 per order.

4. We reserve right to return goods to you if we suspect that goods have been used or any of above conditions are not met.

    

Defective products:

1. We will replace or offer a full refund for any product found to be defective, returned within 28 days of delivery, on the day we receive it back from you. We will also reimburse you for the postage costs. Postage and packaging charges will not be refunded unless item is faulty.

2. If the item is returned as faulty, and it is in fact not faulty – redelivery charge may apply to return the item to you.

3. Refunds for defective products paid for with credit/debid card will NOT incur any administration charge.

4. Refunds will be made either by cheque or credit on your credit card. Please also note that we cannot be responsible for any delays in receipt of cleared funds caused by banking systems.

Sending the parcel

1. Please contact us at returns@maryjanelingerie.co.uk stating reason for return and providing your address, so we could send you freepost return label.

2. When dealing with returns parcel we use Royal Mail 1st Class Recorded delivery, and we cannot be held responsible for any damage or loss of the content of your parcel on its way back to us.

3. Our address is being currently changed. Please use contact us form to obtain return labels and address.

Money Refund

1. In case of any refunds /reimbursements money will be refunded within maximum 30 days of cancellation.

    

General

1. None of terms and conditions are intended to affect your statutory rigths.

2. The Website Terms and Conditions are governed by English law and the courts of England and Wales shall have non-exclusive jurisdiction over any dispute. All correspondence shall be made or conducted in the English language. If you access the Website from countries outside of the UK you do it at your own risk and you are responsible for compliance with local laws.

3. NU cannot be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

1. Any material found within the website may not be used in any way except for your own non-commercial use. All third party copyright trademarks, brand names, product names and titles are acknowld. You hereby agree not to adapt, alter or re-create any of the material from www.maryjanelingerie.co.uk.

2. All trademarks used are properties of their respective owners. Product photography has been supplied by respective brand distributors and is not in breach with the law.

1. Sholuld you have any complaint with regards to any product presented on the website or any service, please contact us via e-mail at info@maryjanelingerie.co.uk. We will make endeavor to acknowledge your enquiry within 5 working days, and advise you how long it will take to resolve the problem.
